Terms & Conditions


This is an agreement between Buyer and Seller (Old Western Land, LLC).

By agreeing to process this transaction through oldwesternland.com (“Website”) or any features thereof, you agree to abide by the Terms and Conditions (“Agreement”) set forth herein. 

  1. Description of Service:
    The website https://oldwesternland.com allows you, the Buyer, to purchase properties from the Seller, Old Western Land, LLC. Buyer has the option to purchase the property by paying the full amount listed in the “Cash Price” section of the property listing or finance the property through Old Western Land, LLC, by selecting the appropriate “Reserve Now” button.
  2. When selecting “Reserve Now” the Buyer is paying Reservation Fees. Reservation Fees include Document Processing Fees and Reservation Fees. These fees are paid with  a credit card. Document Processing Fee and Reservation Fee amounts are outlined in the property listing.
  3. Document Processing Fees include, but are not limited to, fees required for filing and recording the deed with the appropriate county at the conclusion of the sale, set-up fees for the loan (if applicable), fees for drafting contracts and agreements, transaction fees and bank draft fees.
  4. Reservation Fees include the amount due to reserve Buyer’s right to purchase the property and are added to the down payment. Should Buyer complete the purchase of the property as agreed, Reservation Fees, less any Document Fees,  will be included in the deposit.
  5. Buyer understands that the Seller is conveying the described property “as-is” and Buyer agrees to purchase property as such. No representations as to fitness for a particular purpose have been made. No verbal claims or promises have been made to Buyer, which do not appear in writing here. If the described property is not situated on a public road, then Buyer hereby acknowledges such, and agrees to hold Seller harmless for maintenance and improvements to existing easement(s). Buyer also agrees that the Buyer will assume any improvement or utility bonds, and Buyer agrees that if he/she/they did not physically inspect the above property, then Buyer understands that will not constitute grounds for termination of this contract.
  6. Buyer understands that all Document Fees are non-refundable. Should Buyer decide to purchase a different advertised property listed on the Website prior to signing a purchase agreement, Buyer agrees that the Reservation Fees for this property will be applied towards the Reservation Fees of the new property. Should Buyer decide not to purchase a property after paying Reservation Fees, the amount paid will be refunded to Buyer less any Document Fees.
  7. The Website accepts Visa, MasterCard, and American Express branded credit cards to accept payment in USD for the Reservation Fees.
  8. Buyer agrees to the following:
    a.) Buyer is 18 years of age or older. 
  9. b.) Buyer has the appropriate authority to validly accept these Terms and Conditions, are able to, and will meet Buyer’s obligations in relation to Term and Conditions. c.)The credit card used in connection with this transaction is issued in Buyer’s name and Buyer is authorized to use the credit card. 
    d.) Buyer will pay the credit card issuer all charges incurred related to this transaction. 
    e.) All information supplied by Buyer is true and correct.
    9. Buyer agrees to indemnify and hold Old Western Land, LLC, and our subsidiaries, affiliates, officers, agents or other partners, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to Buyer’s use of this website, Buyer’s violation of this Agreement, or any other loss suffered by Old Western Land, LLC, due to Buyer’s direct or indirect conduct.
    10. Seller reserves the right to modify this Agreement or any part thereof. All the changes and updates shall come into effect as soon as they are posted on this web page.
    11. Any dispute that is, or becomes, a subject matter of any provision contained herein shall be subject to the exclusive jurisdiction of laws and courts located in the State of California.
